U.S. Citizenship and Immigration Services (USCIS) has recently published a final rule adjusting certain immigration and naturalization benefit request fees. This is the first fee adjustment since 2016 and aims to help USCIS recover a greater share of its operating costs, facilitating more timely processing of new applications.
The final rule follows a comprehensive fee review, as mandated by law, and comes after the publication of a notice of proposed rulemaking in January 2023. The review highlighted the inadequacy of the current fee schedule in covering the full cost of agency operations, including necessary expansions, federally mandated pay raises, additional staffing requirements, and other essential investments.
Key Points:
1. Fee Adjustments: The final rule lowers the agency's required annual cost recovery by $727 million, considering the budget effects of improved efficiency measures.
2. Fee Exemptions and Discounts: The final rule expands fee exemptions for specific groups, such as Special Immigrant Juveniles, victims of human trafficking, crime, and domestic violence, U.S. military service members, Afghan allies, families pursuing international adoption, nonprofit organizations, and small business employers. It also allows for special fee discounts and reductions for various categories.
3. Online Filers: There is a standard $50 discount for online filers.
4. Limitation on Fee Increase: The final rule limits how much newly established fees may increase. For most individual filers, the new fees will not increase by more than 26%, equivalent to the increase in the Consumer Price Index since 2016.
5. Effective Date: The new fees under the final rule will go into effect on April 1, 2024.

USCIS will accept prior editions of most forms during a grace period from April 1, 2024, through June 3, 2024.
It's important to note that there will be no grace period for specific new forms that require revision with a new fee calculation. Filers should access the preview version of each new form edition before the April 1, 2024, effective date.
